Information about General Data Protection Regulation (GDPR)

We may be collecting and using information from you if you are from the European Economic Area (EEA), and in this section of our Privacy Policy we are going to explain exactly how and why this data is collected, and how we maintain this data under protection from being replicated or used in the wrong way.

What is GDPR?

GDPR is an EU-wide privacy and data protection law that regulates how EU residents' data is protected by companies and enhances the control the EU residents have over their personal data.

The GDPR is relevant to any globally operating company and not just the EU-based businesses and EU residents. Our customers' data is important irrespective of where they are located, which is why we have implemented GDPR controls as our baseline standard for all our operations worldwide.

What is personal data?

Any data that relates to an identifiable or identified individual. GDPR covers a broad spectrum of information that could be used on its own, or in combination with other pieces of information, to identify a person. Personal data extends beyond a person's name or email address. Some examples include financial information, political opinions, genetic data, biometric data, IP addresses, physical address, sexual orientation, and ethnicity.

The Data Protection Principles include requirements such as:

  • Personal data collected must be processed in a fair, legal, and transparent way and should only be used in a way that a person would reasonably expect.
  • Personal data should only be collected to fulfil a specific purpose and it should only be used for that purpose. Organizations must specify why they need the personal data when they collect it.
  • Personal data should be held no longer than necessary to fulfil its purpose.
  • People covered by the GDPR have the right to access their own personal data. They can also request a copy of their data, and that their data be updated, deleted, restricted, or moved to another organization.

Why is GDPR important?

GDPR adds some key requirements regarding how companies should protect individuals' personal data that they collect and process. It also raises the stakes for compliance by increasing enforcement and imposing greater fines for breach. Beyond these facts it's simply the right thing to do. At Lumhe we strongly believe that your data privacy is important and we already have solid security and privacy practices in place that go beyond the requirements of this new regulation.

Individual Data Subject's Rights — Data Access, Portability and Deletion

We are committed to helping our users exercise the data subject rights available to them under applicable data protection law, including the right to access, rectify, port, restrict, object to, or request deletion of their personal data. To exercise any such right, contact our Privacy Officer at [email protected].

We retain personal data only for so long as we reasonably require it to provide the Services, to enforce our Terms, to comply with our legal, tax, regulatory, fraud-prevention, and accounting obligations, and to establish, exercise, or defend legal claims. Following account deletion, we will use commercially reasonable efforts to remove or de-identify personal data within a reasonable period, except where retention is required or permitted by applicable law (for example, in respect of transaction records, security logs, or backup systems). Some data may persist in routine encrypted backups for a longer period before being overwritten in the ordinary course of business.

Information about the Digital Personal Data Protection Act, 2023 (India)

LUMHE TECHNOLOGY LLP is a Limited Liability Partnership incorporated in India and is a Data Fiduciary under the Digital Personal Data Protection Act, 2023 (the "DPDPA") in respect of the personal data of users to whom the DPDPA applies.

What is the DPDPA?

The DPDPA is India's principal data-protection statute. It was enacted on 11 August 2023 and is being brought into force in stages alongside the Digital Personal Data Protection Rules, 2025 (the "DPDP Rules"), notified on 13 November 2025. The DPDPA regulates the processing of "digital personal data" of individuals and provides Indian residents (referred to as "Data Principals") with rights including the right to access, correction, erasure, grievance redressal, and the right to nominate another person to exercise their rights in the event of death or incapacity.

Lawful basis for processing

We process personal data on the following lawful bases, as applicable to your jurisdiction: (a) your consent, given at registration and through your continued use of the Platform; (b) the performance of the contract constituted by our Terms and Conditions; (c) compliance with legal, regulatory, and tax obligations to which we are subject; and (d) our legitimate interests in operating, securing, and improving the Platform, where such interests are not overridden by your rights. Where the DPDPA applies, we rely on your consent or on a "legitimate use" recognised under Section 7 of the DPDPA, as the case may be.

Children's data under the DPDPA

The DPDPA imposes additional obligations in respect of personal data of persons under the age of 18. Section 9 of the DPDPA and the corresponding provisions of the DPDP Rules become enforceable on 12 May 2027. Our approach to children's data is set out in the section titled "Children's Privacy and Age Requirements" above.

Cross-border transfers

Personal data of users in India may be transferred outside India to our vendors, service providers, and infrastructure partners, except to any country or territory that may be restricted by notification of the Central Government under Section 16 of the DPDPA. We will comply with any such restrictions to the extent they apply to us.

Grievance Officer

In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the DPDPA, our Grievance Officer can be contacted as follows:

We will acknowledge complaints within the timelines required by applicable law and endeavour to resolve them within thirty (30) days of receipt, or such shorter period as is required by law. If you are an Indian resident and are not satisfied with the outcome of your complaint, you may have a right to approach the Data Protection Board of India once it is operational and accepting complaints.
